These Terms & Conditions govern the conditions under which the accommodation service offered by Pool and Chill Balaton (the "Provider") may be used by the guest availing themselves of the service (the "Guest").
By submitting a booking, the Guest confirms that they have read and accepted these Terms & Conditions and the Privacy Policy, and acknowledges them as binding.
The language of the contract is Hungarian. The contract is formed when the Provider confirms the booking in writing.
The accommodation consists of two separate apartments:
The stated maximum occupancy may not be exceeded. The accommodation has a pool, the use of which is governed by the house rules.
Bookings can be made through the WP Booking System available on the website, or by email or phone. During the booking, the Guest provides the required details (name, contact information, arrival and departure dates, number and age of guests).
Only a person who is at least 18 years old and has full legal capacity may submit a booking. The Provider records the age of children in order to determine occupancy and the applicable tourist tax.
A booking is not final until the Guest has completed payment. A submitted but unpaid booking does not guarantee the reservation: another Guest may book the same dates until payment is received. The Guest should therefore initiate the bank transfer within 1 hour of submitting the booking, where possible.
The booking becomes final once payment is received by the Provider and the Provider confirms it.
The accommodation fee is as stated on the website and in the booking confirmation. The Provider is exempt from VAT, so the prices do not include VAT. The stated price includes the tourist tax and other service charges.
Payment is made by bank transfer to the following account:
Bank: MBH Bank Nyrt.
Account number (IBAN available on request): 10300002-13236819-00014909
Beneficiary: Róbert Korcsmáros
The Guest may choose between the following two payment options:
The 30% deposit qualifies as earnest money ("foglaló") under Section 6:185 of Act V of 2013 on the Hungarian Civil Code. Payment of the deposit is deemed to conclude the contract. Invoices are issued by the Provider through the NAV Online Invoicing system.
A booking can be cancelled free of charge until the deposit has been paid.
Once the deposit has been paid, the booking cannot be cancelled and the deposit is non-refundable. If the Guest cancels the booking after paying the deposit, or does not use the service, the deposit is forfeited, and the Provider may also claim any further amount already paid for the booked period.
The Provider draws attention to the fact that, under Section 29 (1) l) of Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, in the case of accommodation services where the contract specifies a fixed date or period of performance, the consumer is not entitled to the 14-day right of withdrawal.
The Provider does not require a security deposit.
Chill apartment: the minimum length of stay is 1 night.
Lombkorona apartment: the minimum length of stay is 1 night, except on weekends (Friday and Saturday), when the minimum is 2 nights.
The accommodation can be occupied from 1:00 PM on the day of arrival.
The accommodation must be vacated by 10:00 AM on the day of departure.
Arrival or departure outside these times is only possible by prior arrangement with the Provider.
Detailed rules for using the accommodation are set out in a separate house rules document, available on the website at the House Rules page (under the /hu, /en or /de path, depending on language).
By submitting a booking, the Guest also accepts the house rules. The key points of the house rules are:
The Guest must use the accommodation and its fittings as intended, comply with the house rules, and return the accommodation clean and undamaged upon departure.
The Guest is liable, under the general rules of civil law, for any damage caused intentionally or negligently to the accommodation or its furnishings, and must compensate the Provider for such damage.
The Guest is also responsible for the conduct of any additional persons they bring to the accommodation.
The Provider must make the booked apartment available to the Guest in a condition fit for its intended use, as described in the confirmation.
The Provider is entitled to withdraw from the contract or refuse the service if the Guest seriously breaches the house rules, fails to use the accommodation as intended, or endangers the peace or safety of other Guests or the Provider.
In the event of force majeure (an unavoidable external cause, e.g. a natural disaster or an act of authority) preventing the Provider from performing the service, the parties will settle accounts with each other, and the Provider will refund any amount already paid for the service that was not provided.
The Guest may submit a complaint about the service verbally or in writing, using the Provider's contact details above (email: poolandchillbalaton@gmail.com, phone: +36 30 556 5202). The Provider will investigate the complaint and inform the Guest of the outcome.
If the complaint is not resolved satisfactorily, the Guest, as a consumer, may turn to a conciliation board. The conciliation board competent for the Provider's registered address is:
Somogy County Conciliation Board
Address: 7400 Kaposvár, Anna utca 6., Hungary
Phone: +36 82 501 026
Email: skik@skik.hu
The consumer may also turn to the conciliation board competent for their own place of residence.
The consumer may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
The Guest is also entitled to contact the consumer protection authority or the courts.
The Provider processes the Guest's personal data in accordance with applicable law. Details of the data processing are set out in the Privacy Policy available on the website.
Matters not regulated by these Terms & Conditions are governed by Hungarian law, in particular Act V of 2013 on the Civil Code.
The Provider reserves the right to unilaterally amend these Terms & Conditions. The version in effect at any given time is available on the website. Bookings already submitted and confirmed are governed by the Terms & Conditions in effect at the time of booking.
Should any provision of these Terms & Conditions become invalid, this shall not affect the validity of the remaining provisions.
